1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and FitForce ("we," "us" or "our"), concerning your access to and use of our website, services, and facilities.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services.

2. MEMBERSHIP AND SERVICES

2.1 Membership Eligibility

To be eligible for membership, you must:

  • Be at least 16 years of age (those under 18 require parent/guardian consent)
  • Complete our health questionnaire truthfully
  • Not have any medical conditions that would make exercise dangerous
  • Agree to follow our facility rules and guidelines

2.2 Membership Terms

Your membership agreement includes:

  • The type of membership selected
  • Applicable fees and payment schedule
  • Duration of membership (if applicable)
  • Access to specific services and facilities as outlined in your membership plan

2.3 Payment and Fees

By signing up for a membership, you agree to the following:

  • Payment of all fees associated with your membership type
  • Authorization for automatic billing if you select a recurring payment option
  • Responsibility for any additional charges for services not included in your membership
  • Payment of any applicable late fees for overdue payments

We reserve the right to modify our fees with 30 days' notice to members.

2.4 Cancellation Policy

You may cancel your membership by providing written notice at least 30 days before your next billing date. Cancellation requests must be submitted in writing to our facility or via email to [email protected].

Refunds may be issued according to our refund policy, which varies based on membership type and circumstances of cancellation.

3. FACILITY RULES AND CODE OF CONDUCT

While using our facilities, you agree to:

  • Treat all staff and members with respect
  • Use equipment properly and safely
  • Clean equipment after use
  • Wear appropriate athletic attire and footwear
  • Follow all posted rules and staff instructions
  • Not engage in any behavior that disrupts others' workouts

We reserve the right to refuse service or terminate membership for individuals who violate these rules.

4. HEALTH AND SAFETY

By using our facilities, you acknowledge that:

  • Exercise carries inherent risks
  • You are responsible for exercising within your physical capabilities
  • You should consult with a physician before beginning any exercise program
  • You must inform us of any changes to your health that may affect your ability to exercise safely

5. LIABILITY WAIVER

By using our services, you agree to waive, release, and discharge FitForce and its employees from any and all liability for:

  • Personal injury
  • Property damage or loss
  • Death

This waiver applies whether such injuries or damages arise from negligence, equipment malfunction, or any other cause, to the fullest extent permitted by law.

6. INTELLECTUAL PROPERTY

All content on our website and materials provided during services, including but not limited to text, graphics, logos, images, and software, is the property of FitForce and is protected by copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works based on our content without our express written consent.

7. PRIVACY

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify members of any significant changes via email or posted notice at our facility. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

10. DISPUTE RESOLUTION

Any dispute arising from these Terms shall first be addressed through informal negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Toronto, Ontario, in accordance with the rules of the ADR Institute of Canada.
